SHIPPING, DELIVERY, AND COLLECTION TERMS & CONDITIONS
These terms and conditions govern the shipment, delivery, and collection of products purchased
on the eHustle Platform. By purchasing a product, the Buyer agrees to be bound by these
terms.
1. Definitions
- Platform: eHustle (the facilitator of the transaction).
- Seller: The independent third-party vendor listing and supplying the goods.
- Buyer: The user purchasing the goods from the Seller via the Platform.
- Goods: The products purchased by the Buyer.
- Integrated Courier: The Platform’s pre-approved third-party courier service used for all deliveries under the “Deliver” mode.
2. Fulfillment Modes and Cost Responsibility
At the time of checkout, the Buyer will select one of two fulfillment modes:
2.1. Deliver Mode (Buyer Pays Shipping)
- Shipping Provider: All deliveries under this mode must be conducted using the Platform’s Integrated Courier or a service mandated by the Platform.
- Cost Responsibility: The Buyer is responsible for all shipping costs associated with the “Deliver” mode. The shipping fee is calculated automatically at checkout based on the Seller’s product information and the Buyer’s delivery address, and is added to the total order value.
- Seller Obligation: The Seller must accurately input product weight and dimensions to ensure correct shipping cost calculation. The Seller is responsible for securely packaging the Goods for transport.
2.2. Collect Mode (Buyer Collects)
- Cost: This option is free of charge to the Buyer.
- Arrangement: The Seller must make the Goods available for collection within the stipulated processing time. The Seller and Buyer are responsible for communicating and agreeing upon a mutually convenient time and secure location for the collection.
- Risk Transfer: Risk of loss or damage transfers to the Buyer at the moment the Buyer, or their appointed representative, takes physical possession of the Goods.
Seller Obligations and Processing Times
3.1. Processing and Handover
The Seller commits to:
- Processing Time: Processing the order (picking and packaging) and handing the Goods over to the Integrated Courier or making them available for collection within a
maximum of two (2) business days from the confirmation of payment. - Tracking: Providing the Buyer with a valid tracking number and the courier’s name via the Platform within one (1) business day of the Goods being handed over.

3.2. Estimated Delivery Time
- The estimated delivery timeframe (typically 3–7 business days after handover) is provided by the Integrated Courier. While the Platform facilitates this information, delivery times are estimates only and are not binding guarantees.
- In the event of significant delays (beyond the estimated time), the Seller must proactively communicate this to the Buyer.
4. Risk, Ownership, and Liability (CPA Compliance)
4.1. Risk of Loss or Damage

- In terms of the Consumer Protection Act (CPA), the risk of loss or damage to the Goods remains with the Seller until the Goods are successfully delivered to the Buyer, their nominated recipient, or their representative, at the specified delivery address.
- If the Goods are lost or damaged prior to delivery, the Seller is responsible for arranging a replacement or a full refund to the Buyer.
4.2. Delivery Completion
Delivery is deemed complete and risk transfers to the Buyer when:-
- The Goods are physically handed over to the Buyer or a responsible person at the specified address.
- The Buyer signs the delivery manifest or the courier’s electronic proof of delivery (POD).
5. Failed Delivery and Undeliverable Shipments
5.1. Delivery Attempts
The Integrated Courier will typically attempt delivery at least two (2) times. If delivery fails due to the Buyer’s non-availability, refusal (without valid cause, e.g., damage), or incorrect address
details:
- The Seller may request that the Buyer pay an additional reasonable fee for a third delivery attempt.
- If delivery still cannot be completed, the Goods will be returned to the Seller, and the Buyer will be refunded the cost of the Goods, less any original shipping fees and any incurred return shipping and restocking fees, which the Platform may deduct on the Seller’s behalf.
5.2. Inspection on Delivery
The Buyer has the right to inspect the Goods upon delivery. If the packaging is clearly damaged or if the Goods received are incorrect or defective, the Buyer should:-
- Note the damage on the courier’s POD (if possible).
- Refuse the delivery, or accept it and immediately notify the Seller via the Platform within 24 hours of receipt to initiate a return or exchange claim.
6. General Provisions
- Insurance: The Platform strongly recommends that Sellers ensure their Goods are adequately insured against loss or damage during transit.
- Force Majeure: Neither the Platform nor the Seller shall be held liable for failure to perform their obligations due to events beyond their reasonable control, including but not limited to, national courier strikes, natural disasters, or government restrictions.
- Governing Law: These terms are governed by the laws of the Republic of South Africa.
