Listing Policy

MARKETPLACE LISTING POLICY

This Listing Policy sets out the rules and standards that all Sellers must comply with when listing products or services on the eHustle platform. Compliance with this policy is mandatory and protects the integrity of our marketplace and the safety of our Buyers.

1. General Listing Principles (Accuracy and Legality)

Every listing must adhere to the following core principles:

1.1. Accuracy and Disclosure

Truthfulness: All information provided in the listing (description, title, images, condition) must be 100% accurate and represent the item being sold. Misleading titles or descriptions are strictly prohibited.
Condition Disclosure: The product’s condition (New, Used, Refurbished) must be clearly stated. For used items, any defects, faults, or wear-and-tear must be explicitly detailed and photographed.
Voetstoots Clause: The common law voetstoots clause (selling an item “as is”) does not apply to transactions governed by the Consumer Protection Act (CPA). Sellers must comply with the implied warranty of quality, regardless of a voetstoots clause.

1.2. Pricing and Fees

Final Price: The price listed must be the final selling price for the item and must include all costs, excluding only the shipping fee (if the Buyer chooses “Deliver”).
VAT/Tax: Sellers are responsible for correctly stating whether the price includes or excludes VAT, in line with their tax registration status.

Homeware	6.0%	Includes kitchenware, bedding, lighting, and décor.
Arts and Crafts	7.0%	Includes paints, canvases, crafting supplies, and hobby materials.
Fashion and Jewelery	7.25%	Includes clothing, footwear, watches, and fine jewelry (usually the highest category).
Services	8.0%	Used for listings that are non-tangible, subscription-based, or installation services.

Fee Calculation Methodology

The commission fee is calculated as follows:

Commission Amount = Total Sale Price x Category Commission Rate

Total Sale Price: This refers to the retail price of the product before VAT and excluding shipping fees.
Shipping Fees: If the buyer pays for delivery (the “Deliver” option), the shipping fees are generally not subject to marketplace commission, as they are a direct cost passed to the courier.

1.3. Legal Compliance

Legality: All products listed must be legal for sale in South Africa and comply with all applicable local, provincial, and national laws and regulations (including health, safety, and trade standards).

2. Listing Content and Quality Standards

High-quality content is required to ensure a professional shopping experience.

2.1. Titles and Descriptions

Clarity: Titles must be relevant to the product and contain only necessary information (brand, model, key features). Excessive keywords or emojis are not permitted.
Language: Descriptions must be written clearly in English and use proper grammar and spelling.
External Links: Descriptions may not contain links, contact details, or references to external websites, social media profiles, or third-party sales platforms.

2.2. Images

Quality: All images must be clear, well-lit, and high-resolution.
Relevance: Images must accurately depict the product being sold, including all accessories or packaging. Stock images are acceptable but must be accompanied by at least one photograph of the actual item for sale, especially for used, refurbished, or custom goods.
No Watermarks: Images may not contain any external website URLs, logos, or watermarks other than your own business logo (used discreetly).

2.3. Category and Specifications

Correct Categorisation: Items must be listed in the most appropriate category and sub-category. Incorrect categorisation to avoid higher commission fees will result in the listing being removed and potential penalties.
Mandatory Fields: All required fields, including accurate weight and dimensions (essential for calculating courier fees), must be completed.

3. Prohibited and Restricted Items

The following items are strictly prohibited from being listed on the Platform. Listings containing these items will be immediately removed, and the Seller’s account may be suspended.

Counterfeit and Replica Goods: Any item that infringes upon the intellectual property (IP) rights of others, including trademark, patent, or copyright infringement. This includes unauthorized replicas, knock-offs, or fake goods.
Illegal and Regulated Items: Drugs, controlled substances, illegal paraphernalia, human organs, and illegal gambling machines.
Weapons and Dangerous Goods: Firearms, ammunition, explosives, harmful chemicals, and any item that cannot be safely and legally shipped via standard courier services.
Hate Speech and Offensive Content: Any item promoting discrimination, violence, or illegal acts based on race, gender, religion, sexual orientation, or nationality.
Adult Content: Pornography, explicit sexual content, or sexually suggestive items, with the exception of clearly labeled adult novelty items in an approved, restricted category.
Financial Instruments: Securities, bonds, currency (unless collectible/numismatic), credit card numbers, or any financial data.
Stolen Property: Any item the Seller does not have the legal right to sell.

4. Intellectual Property (IP) and Authenticity

The Seller is fully responsible for ensuring that all items listed are authentic and that their listings do not infringe upon any third-party IP rights.

4.1. Counterfeit Goods: Sellers must be able to provide proof of authenticity, license, or origin upon request by the Platform. The sale of counterfeit goods is a material breach of this policy
4.2. Brand Use: Sellers may use brand names only to identify the genuine product they are selling. Misuse of trademarks (e.g., using a competitor’s brand name in a title to draw traffic) is prohibited.
4.3. Consequences: If the Platform receives a valid IP infringement complaint from a brand owner, the listing will be immediately removed, and the Seller will face immediate suspension or termination.

5. Non-Compliance and Enforcement

5.1. Audit and Review: eHustle reserves the right to review, audit, or remove any listing at any time, with or without prior notice, if it violates this policy or is deemed misleading, inappropriate, or harmful to the Buyer experience.
5.2. Penalties: Violations will be handled according to the following escalating scale:
* First Offence: Listing removed; Warning issued to the Seller.
* Second Offence: Listing removed; 7-day suspension of selling privileges.
* Third Offence or Major Breach (e.g., Counterfeits): Permanent termination of the Seller’s account, and the Seller may be permanently banned from the Platform.
